Introduction.
Your privacy is important to us. This privacy policy applies to the software application and/or software solution (hereby referred to as "App") that was created by A3Cloud Solutions (hereby referred to as "App Provider") as a Commercial service. This service is intended for use "AS IS". It is A3Cloud Solutions' policy to respect your privacy regarding any information we may collect from you across App we own and/or operate. We collect Your information by fair and lawful means, with your knowledge and consent.

This Privacy Policy describes Our ("we", "us" or "our") policies and procedures on the collection, protection, use and disclosure personally identifiable information You ("User", "you" or "your") may provide on the App and any of its products or services (collectively, "App") and tells You about Your privacy rights and how the law protects You.

It also describes the choices available to you regarding our use of your Personal Information and how you can access and update this information. This Policy does not apply to the practices of companies that we do not own or control, or to individuals that we do not employ or manage.

The App is based, , and/or use, and/or is settled, and/or is hosted on Microsoft Cloud Services. As part of long-term commitment to Trustworthy Computing, Microsoft strives to earn and strengthen trust by building robust privacy and data protections into Microsoft products and services. A dedicated team at Microsoft focuses on guiding development teams to deliver secure, privacy-focused, and reliable computing experiences based on sound business practices. The privacy group manages Microsoft' privacy governance program, which includes ongoing employee training, identification of emerging privacy issues in the industry, and regular updates to privacy standards.
The Microsoft Corporate Privacy Policy comprises six key principles for the protection and appropriate use of customer information, such as information submitted by customers, data obtained from third parties, and data that is collected automatically. Microsoft’s six key privacy principles are:
  • Control. Microsoft will put you in control of your privacy with easy-to-use tools and clear choices.
  • Transparency. Microsoft will be transparent about data collection and use so you can make informed decisions.
  • Security. Microsoft will protect the data you entrust to us through strong technical and organizational security measures and state-of-the art encryption mechanisms.
  • Strong legal protections. Microsoft will respect your local privacy laws and fight for legal protection of your privacy as a fundamental human right.
  • No content-based targeting. Microsoft will not use your email, chat, files, or other personal content to target ads to you.
  • Benefits to you. When Microsoft do collect data, Microsoft will use it to benefit you and to make your experiences better.
These principles form the foundation of Microsoft’s approach to privacy and they will continue to shape the way we build our products and services. Microsoft’s consumer and business products and services are developed with strict adherence to Microsoft’s privacy standards and principles. These standards inform Microsoft employees and vendors about how to develop products and services with customer privacy in mind so that customers can better understand and control the collection, storage, retention, destruction, and use of their data. Microsoft Trust Center. Although many organizations cite privacy and security concerns as major obstacles to their adoption of cloud services, information on the privacy and security practices of many cloud providers is either difficult to find or indecipherable to all but the most astute IT professionals. To help our customers find answers to their privacy and security questions about our cloud services, Microsoft strive to be as transparent as possible about our data protection policies and procedures. The centerpiece of Microsoft transparency efforts is the Microsoft Trust Center, an online repository of detailed information about the privacy and security practices in Microsoft Azure, Microsoft Office 365, Microsoft Dynamics, Microsoft Intune, Microsoft Power BI, and other cloud services. The Microsoft Trust Center is designed to provide answers to questions that customers have about Microsoft cloud services, such as who can access their data, where their data is stored, and how they can verify that Microsoft is doing what it says. Microsoft's compliance is independently audited, and transparent on many levels—from how Microsoft complies with regulatory requirements, to how Microsoft handles legal demands for customer data, to the security of Microsoft's code. By downloading, and / or installing, and / or using the App, You agree to the collection and use of information in accordance with this App Privacy Policy.

Definitions.
For the purposes of this Application Privacy Policy:
  • You means the individual visiting, accessing or using the App, or the company, or other legal entity on behalf of which such individual is accessing or using the App, as applicable.
  • Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to A3Cloud Solutions Sp.z o. o., Bartycka str., nr 22B, lok. 21A, Warsaw, 00-716, Poland.
  • Affiliate means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
  • Account means a unique account created for You to access our App.
  • Country refers to: Republic of Poland.
  • Personal Data is any information that relates to an identified or identifiable individual.
  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

Information We Collect.
We may collect the following types of information:
  • Personal Information: Information that can be used to identify you, such as your name, email address, phone number, and payment information.
  • Usage Data: Information about how you use our App, such as the features you use, the actions you take, and the time, frequency, and duration of your activities.
  • Device Information: Information about the device you use to access our App, including the hardware model, operating system, and/or IP address.
For some cases You can use the App as authenticated user from your company Microsoft Cloud tenant without telling us who you are or revealing any information by which someone could identify you as a specific, identifiable individual. If, however, the App is licensed by per User model, you will provide certain Personal Information (for example, your name and e-mail address). We receive and store any information you knowingly provide to us when you use the App.
While using Our App, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:
  • Email address
  • First name and last name
  • Phone number
  • Usage Data
Users who are uncertain about what information is mandatory are welcome to contact us.

Usage Data. Automatic collection of information.
Our top priority is customer data security and, as such, we exercise the logs policy. We process only minimal user data, only as much as it is necessary to maintain the App. Information collected automatically is used to identify potential cases of abuse and establish statistical information regarding App usage. This statistical information is not otherwise aggregated in such a way that would identify any particular user of the system.
Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our App that You use, the time and date of Your usage, the time spent on particular pages, unique device identifiers and other diagnostic data.
When You access the App by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.
We may also collect information that Your browser sends whenever You use our App or when You access the App by or through a mobile device.

Use and processing of collected information.
In order to make our App available to you, or to meet a legal obligation, we need to collect and use certain Personal Information. If you do not provide the information that we request, we may not be able to provide you with the requested products or services. Some of the information we may collect is directly from you via our App. However, we may also collect Personal Information about you from other sources. The Company may use Personal Data for the following purposes:
  • To provide, operate, and maintain our App, including to monitor the usage of our App.
  • To improve, personalize, and expand our App.
  • Understand and analyze how you use our App.
  • Develop new products, services, features, and/or functionality.
  • To manage Your Account: to manage Your registration as a user of the App (if applicable). The Personal Data You provide can give You access to different functionalities of the App that are available to You as a registered user.
  • For the performance of a contract: the development, compliance and undertaking of the purchase contract for the App You have purchased or of any other contract with Us .
  • To contact You: To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including the security updates, when necessary or reasonable for their implementation.
  • To provide You with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless You have opted not to receive such information.
  • To manage Your requests: To attend and manage Your requests to Us.
  • To find and prevent fraud.
  • To Protect from abuse and malicious users, respond to legal requests and prevent harm.
Processing your Personal Information depends on how you interact with our App, where you are located in the world and if one of the following applies:
  1. You have given your consent for one or more specific purposes. This, however, does not apply, whenever the processing of Personal Information is subject to California Consumer Privacy Act or European data protection law;
  2. Provision of information is necessary for the performance of an agreement with you and/or for any pre-contractual obligations thereof;
  3. Processing is necessary for compliance with a legal obligation to which you are subject;
  4. Processing is related to a task that is carried out in the public interest or in the exercise of official authority vested in us;
  5. Processing is necessary for the purposes of the legitimate interests pursued by us or by a third party.

Note that under some legislations we may be allowed to process information until you object to such processing (by opting out), without having to rely on consent or any other of the following legal bases below. In any case, we will be happy to clarify the specific legal basis that applies to the processing, and in particular whether the provision of Personal Information is a statutory or contractual requirement, or a requirement necessary to enter into a contract.

We may share your personal information in the following situations:
  • For Business transfers: We may share or transfer Your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of our business to another company.
  • With Affiliates: We may share Your information with Our affiliates, in which case we will require those affiliates to honor this Application Privacy Policy. Affiliates include Our parent company and any other subsidiaries, joint venture partners or other companies that We control or that are under common control with Us.
  • With Business partners: We may share Your information with Our business partners to offer You certain products, services or promotions.
  • Service Providers: We may share your information with third-party service providers who perform services on our behalf, such as payment processing, data analysis, email delivery, hosting services, customer service, and marketing assistance.
  • Legal Requirements: We may disclose your information if required to do so by law or in response to valid requests by public authorities (e.g., a court or a government agency).

Retention of Your Personal Data.
The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.
The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our App, or We are legally obligated to retain this data for longer time periods.

Information transfer and storage.
Depending on your location, data transfers may involve transferring and storing your information in a country other than your own. You are entitled to learn about the legal basis of information transfers to a country outside the European Union or to any international organization governed by public international law or set up by two or more countries, such as the UN, and about the security measures taken by us to safeguard your information. Your information, including Personal Data, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of Your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from Your jurisdiction.
Your consent to this Application Privacy Policy followed by Your submission of such information represents Your agreement to that transfer.
The Company will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of Your data and other personal information.

Disclosure of Your Personal Data.
Business Transactions
If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.

Law enforcement
Under certain circumstances, the Company may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

Other legal requirements
The Company may disclose Your Personal Data in the good faith belief that such action is necessary to:
  • Comply with a legal obligation
  • Protect and defend the rights or property of the Company
  • Prevent or investigate possible wrongdoing in connection with the Service
  • Protect the personal safety of Users of the App
  • Protect against legal liability

Security of Your Personal Data.
The security of Your Personal Data is important to Us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While We strive to use commercially acceptable means to protect Your Personal Data, We cannot guarantee its absolute security.
We secure information you provide on computer servers in a controlled, secure environment, protected from unauthorized access, use, or disclosure. We maintain reasonable administrative, technical, and physical safeguards in an effort to protect against unauthorized access, use, modification, and disclosure of Personal Information in its control and custody. However, no data transmission over the Internet or wireless network can be guaranteed. Therefore, while we strive to protect your Personal Information, you acknowledge that
  1. there are security and privacy limitations of the Internet which are beyond our control;
  2. the security, integrity, and privacy of any and all information and data exchanged between you and our App cannot be guaranteed; and
  3. any such information and data may be viewed or tampered with in transit by a third-party, despite best efforts.

Data breach.
In the event we become aware that the security of the App has been compromised or users Personal Information has been disclosed to unrelated third parties as a result of external activity, including, but not limited to, security attacks or fraud, we reserve the right to take reasonably appropriate measures, including, but not limited to, investigation and reporting, as well as notification to and cooperation with law enforcement authorities. In the event of a data breach, we will make reasonable efforts to notify affected individuals if we believe that there is a reasonable risk of harm to the user as a result of the breach or if notice is otherwise required by law. When we do, we will post a notice on the Company website and/or send you an email.

Your Data protection rights.
Depending on your location you may have certain rights regarding your information processed by us. In particular, you have:
  1. the right to access – You have the right to request copies of your personal data;
  2. the right to rectification – You have the right to request that we correct any information you believe is inaccurate or complete information you believe is incomplete;
  3. the right to withdraw consent where you have previously given your consent to the processing of your information;
  4. the right to object the processing - You have the right to object to the processing of your information if the processing is carried out on a legal basis other than consent;
  5. the right to learn if information is being processed by us, obtain disclosure regarding certain aspects of the processing and obtain a copy of the information undergoing processing;
  6. the right, under certain circumstances, to restrict the processing of your information, in which case, we will not process your information for any purpose other than storing it;
  7. the right, under certain circumstances, to obtain the erasure of your Personal Information from us;
  8. the right to receive your information in a structured, commonly used and machine readable format and, if technically feasible, to have it transmitted to another controller without any hindrance. This provision is applicable provided that your information is processed by automated means and that the processing is based on your consent, on a contract which you are part of or on pre-contractual obligations thereof.

The right to object to processing.
Where Personal Information is processed for the public interest, in the exercise of an official authority vested in us or for the purposes of the legitimate interests pursued by us, you may object to such processing by providing a ground related to your particular situation to justify the objection. You must know that, however, should your Personal Information be processed for direct marketing purposes, you can object to that processing at any time without providing any justification. How to exercise these rights.
Any requests to exercise User rights can be directed to the Owner through the contact details provided in this document. These requests can be exercised free of charge and will be addressed by the Owner as early as possible.

California privacy rights.
In addition to the rights as explained in this Application Privacy Policy, California residents who provide Personal Information (as defined in the statute) to obtain products or services for personal, family, or household use are entitled to request and obtain from us, once a calendar year, information about the Personal Information we shared, if any, with other businesses for marketing uses. If applicable, this information would include the categories of Personal Information and the names and addresses of those businesses with which we shared such personal information for the immediately prior calendar year (e.g., requests made in the current year will receive information about the prior year). GDPR Compliance.
In addition, for Customers located in European Union, our App is committed to protecting your privacy and ensuring that your personal data is handled in accordance with the General Data Protection Regulation (GDPR). We collect, process, and store your data only for legitimate purposes and with your explicit consent. You have the right to access, rectify, or delete your personal information at any time. We implement robust security measures to safeguard your data against unauthorized access, alteration, or disclosure. For any concerns or requests regarding your data, please contact our Data Protection Officer at contact@a3cloud.org.

Children's Privacy.
Our App does not address anyone under the age of 18. We do not knowingly collect any personally identifiable information from anyone under the age of 18. If you are under the age of 18, please do not submit any Personal Information through our App. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 18 without verification of parental consent, We take steps to remove that information from Our servers.
We encourage parents and legal guardians to monitor their children's Internet usage and to help enforce this Policy by instructing their children never to provide Personal Information through our App without their permission.
You must also be at least age to consent to the processing of your Personal Information in your country.

Changes to this App Privacy Policy.
We may update this App Privacy Policy from time to time in our discretion and will notify you of any material changes to the way in which we treat Personal Information. We will notify You of any changes by posting the new Privacy Policy on this page.
App's users are encouraged to check this policy for such changes.
When changes are made, we will revise the updated date at the bottom of this page. We may also provide notice to you in other ways in our discretion, such as through contact information you have provided. Any updated version of this Privacy Policy will be effective immediately upon the posting of the revised Privacy Policy unless otherwise specified. Your continued use of the App after the effective date of the revised Application Privacy Policy (or such other act specified at that time) will constitute your consent to those changes. However, we will not, without your consent, use your Personal Data in a manner materially different than what was stated at the time your Personal Data was collected.
